11. Data Subject Rights

Depending on your jurisdiction, you may be entitled to exercise some or all of the following rights regarding your personal and health data processed by Ai Dent:

11.1 Right to Access

You have the right to obtain confirmation of whether Ai Dent processes your personal or health data. On request, we will provide a copy of the personal data we hold about you, along with information about the purposes of processing, categories of data involved, recipients with whom data has been shared, and applicable retention periods.

11.2 Right to Rectification

If any personal or health data we hold about you is inaccurate, incomplete, or outdated, you have the right to request correction. For clinical accuracy, rectifications to health records (such as annotations to x-rays) may also require confirmation by the treating practitioner.

11.3 Right to Erasure / Deletion (“Right to be Forgotten”)

You may request deletion of your personal or health data in the following circumstances:

● The data is no longer necessary for the purpose for which it was collected.

● You withdraw consent and no other legal basis for processing exists.

● The data was unlawfully processed.

● You object to processing and no overriding legitimate grounds exist.

Please note: In healthcare contexts, certain medical records may need to be retained by clinics under statutory obligations, even after an erasure request. In such cases, your data may be securely archived or anonymized.

11.4 Right to Withdraw Consent

Where processing is based on your explicit consent (e.g., analysis of your dental x-rays), you may withdraw consent at any time. Withdrawal will not affect the lawfulness of processing carried out prior to withdrawal, but it may impact Ai Dent’s ability to continue providing services.

11.5 Right to Restrict Processing

You may request that Ai Dent restrict (temporarily suspend) the processing of your personal data in certain scenarios, such as:

● When you contest the accuracy of data (pending verification).

● When processing is unlawful, but you prefer restriction instead of deletion.

● When Ai Dent no longer requires the data, but you need it for legal claims.

● When you have objected to processing, pending verification of legitimate grounds.

11.6 Right to Data Portability

You may request a copy of your personal data in a structured, commonly used, machine-readable format (e.g., JSON, CSV, or DICOM for x-ray images) and may transmit it to another service provider where technically feasible. This right applies to data processed by automated means and based on consent or contract.

11.7 Right to Object to Processing

You have the right to object to the processing of your personal or health data in specific cases, including processing for:

● Direct marketing (where applicable).

● Profiling or AI-driven analytics that you believe adversely affect your rights.

● Processing based on legitimate interests, unless compelling grounds override your objection.

11.8 Right to Lodge a Complaint with a Regulator

If you believe your data protection rights have been infringed, you have the right to lodge a complaint with your local supervisory authority (e.g., the Data Protection Board of India under DPDPA, the ICO in the UK, or the Data Protection Authority in your EU member state). For US clients, HIPAA complaints can be submitted to the Office for Civil Rights (OCR).

11.9 DPDPA Right to Nominate
